Chapter 192, 193 and IDEA

Chapter 192 provides services to eligible students who attend non-public schools. The services covered under Chapter 192 include: 

• Compensatory Education
• English as a Second Language
• Home Instruction

Compensatory Education

MOESC provides Compensatory Services to nonpublic schools using indicators determined by the New Jersey Dept. of Education. Following DOE guidelines, students may be eligible for assistance in the areas of Math or Language Arts. Eligibility for the Compensatory Education program are made through the following criteria:.

• State approved standardized tests
• Teacher anecdotal notes
• Formative and summative assessments and observations

English as a Second Language

MOESC provides English as a Second Language (ESL) services to non-public students who meet eligibility criteria.  When students score below proficiency levels on an approved ESL assessment, they would qualify for services. ESL instruction includes reading, comprehension, listening, and writing. 

Home Instruction 

Through Chapter 192, home instruction is available for students who are enrolled full-time in a non-public school. The Home Instruction program has certified teachers available to assist students who are out of their school setting due to temporary or persistent medical reasons that interfere with participation in their usual school setting.

 

Chapter 193 provides services to students who have Individualized Service Plans (ISP) in a nonpublic school setting.   

Under Chapter 193, the services covered include:

• Child Study Team
• Supplemental Instruction
• Speech and Language Services

Child Study Team

The Child Study Team (CST) provides Evaluation and Determination of Eligibility Services in compliance  with the N.J.A.C. Title 6A, Chapter 14 and PRISE (Parental Rights in Special Education).

Supplemental Instruction

MOESC provides Supplemental Instruction (SI) in the areas of Language Arts or Math to students with an Individualized Service Plan. All direct instruction is tied to the New Jersey Student Learning Standards for the specified grade level. The teachers utilize engaging, educational activities to help students with skill development.

• Students may receive SI within a general education class, “push-in” or  “pull-out” resource program in accordance with N.J.A.C. 6A:26-6
• All direct instruction is based on needs outlined in the Individualized Service Plan

The Individuals with Disabilities Education Act (IDEA) provides Federal Funds for students with special needs. IDEA has four parts, part A,B,C, and D.

IDEA - Part B relates to Special Education Services: “Assistance for All Children with Disabilities.” Each year, districts receive federal funding that is allocated for students with special needs in nonpublic schools. 

MOESC contracts with numerous districts to provide services under IDEA-B to non-public school students. The program and services identified are dependent upon the availability of IDEA non-public funding. The public school district, in annual consultation with the non-public schools, determines the services provided to eligible non-public school students. 

MOESC works with the public districts and non-public schools for the following:

• Coordinating and evaluating the requests from the nonpublic school personnel and verifying expenditures with public school administrators
• Securing certified and/or licensed staff to provide direct services
• Providing instructional material and equipment that can enhance the student's educational program
• Accounting and maintaining fiscal management of all IDEA non-public funds for each participating public school district
